Starting in 2025, inspections related to the disposal of electronic equipment will undergo significant changes, following the update of the National Solid Waste Policy (Law No. 12,305/2010), complemented by recent regulations and resolutions that reinforce shared responsibility and criteria for environmentally appropriate treatment and disposal.
According to Decree No. 10,936/2022 and the resolutions of SINIR (National System of Information on Solid Waste Management), agents handling electronic waste must meet stricter criteria for control, traceability, and verification of the waste flow. The National Solid Waste Policy (Law No. 12,305/2010) requires that electronic disposal be carried out in a way that minimizes environmental impacts and avoids improper disposal in conventional landfills.
The adjustment in inspection actions by IBAMA and state agencies, such as CETESB, will be intensified to ensure compliance with the legislation. There is a forecast of increased fines and administrative sanctions for those who violate the rules, including seizure of materials and even suspension of activities related to electronic waste management.
With the intensification of inspections, proper electronic waste collection becomes indispensable. Correct separation, storage, and disposal of electronic waste are essential for environmental control and to avoid environmental and legal liabilities.
Special attention will be given to the safe disposal of storage devices, such as HDs and other media. Specific procedures for secure destruction and sanitization are mandatory to ensure the protection of sensitive data and compliance with the General Data Protection Law (Law No. 13,709/2018).
To meet the new requirements, it is crucial to implement processes that ensure documentary control of waste, hiring specialized services for collection, transport, and environmentally appropriate disposal. Additionally, fostering training for those involved in management and awareness of legal responsibilities prevents liability risks and reinforces environmental governance.
The changes in inspections in 2025 reinforce the need for compliance at all stages of electronic equipment disposal. Strict adherence to legislation promotes sustainability, information security, and prevents negative environmental impacts.
